Terms and Conditions

Terms and Conditions for the use of the EasyBorderò service. Read carefully before using the platform.

Last revision: 2 June 2026 — Version 1.2.2

ℹ️ §5-ter Email Communications — activation status — the internal custom email management system described in §5-ter is in progressive cutover since 31 May 2026. At present, you receive transactional emails of the SYSTEM category (account verification, password reset, payment confirmation) and can access the preference center from Account > Email Preferences to manage your preferences, as well as use the one-click unsubscribe in the footer of each eligible email. The PRODUCT_UPDATE and MARKETING categories are technically prepared but their actual sending will be enabled progressively, with explicit notification to users at go-live. Until then, you do not receive any PRODUCT_UPDATE or MARKETING email; the §10 provisions regarding the retention of consent history apply only from the actual activation of the relevant categories. The legally binding version is the Italian original.

Non-affiliation statement with SIAE. EasyBorderò is an independent automation tool and is in no way affiliated with, sponsored by, endorsed by, or connected to the Italian Society of Authors and Publishers (Società Italiana degli Autori ed Editori). SIAE® is a registered trademark of SIAE — Società Italiana degli Autori ed Editori. All rights in such trademark belong to the respective holders.

Right of withdrawal — 14 days. Pursuant to Art. 52 of the Italian Consumer Code (D.Lgs. 206/2005), you have the right to withdraw from the contract within 14 days of subscription without penalty and without providing any justification. To exercise withdrawal, write to support@easybordero.it.

1. Definitions

  • EasyBorderò — the SaaS platform and its data controller (Tune Mates di Olivari Marco (sole proprietorship) — VATIT03340720212).
  • User — natural or legal person who registers and uses the platform.
  • Service — the set of functionalities offered by the platform (see art. 2).
  • Plan — the subscription level chosen by the User (Free, Pro, Agency).
  • SIAE — Società Italiana degli Autori ed Editori, the Italian collective rights management body.
  • Borderò — the music program that DJs registered with SIAE must submit for the reporting of performed tracks.

2. Subject of the contract

EasyBorderò provides the User with a SaaS platform that includes the following functionalities:

  • Playlist import from the main DJ software (Rekordbox, Serato — legacy V2 and Serato 4.0 SQLite formats, djay by Algoriddim, generic CSV) and enabled streaming services.
  • Automated generation of the borderò/music program and related submission to the SIAE reserved area.
  • AI-assisted matching to associate imported tracks with the SIAE catalog. Match requests are made via Google Gemini API with data limited to artist, title and duration of the track (no personal data of the User).
  • Track archive and music registry management.
  • Optional publication on social networks owned by the User (Meta — Facebook and Instagram), at the User's initiative, after connecting the social account.
  • Referral program: Users can distribute personalized links of type /r/<code> to invite new DJs; the economic conditions of the program (any discounts or bonuses) are described in the user dashboard.
  • Multilingual editorial blog with informative articles on SIAE, copyright, DJ software and similar.
  • Customer support via AI triage: emails sent to support@easybordero.it are pre-processed by an automatic system based on Anthropic Claude for classification and response draft generation, with local pre-scrubbing of sensitive data (see Privacy Policy §2.8). The sending of the final response remains under human control.

The Service is intended primarily for professional and semi-professional Italian DJs registered with SIAE.

3. Acceptance of terms

Registration on the platform or use of the Service, even only in Free mode, constitutes integral acceptance of these Terms and Conditions and the Privacy Policy. If you do not accept these terms, do not use the Service.

4. Account and security

The User is responsible for the confidentiality of their access credentials (EasyBorderò email and password) and all activities carried out through their account.

The User declares to be in possession of valid SIAE credentials and to be authorized to use them. EasyBorderò stores SIAE credentials in encrypted form (AES-256-GCM with key rotation) and uses them exclusively for automation authorized by the User themselves.

To protect the User's account, EasyBorderò performs an automatic verification of the password provided at registration and reset against public databases of compromised credentials (service "Have I Been Pwned" in k-anonymity mode, see Privacy Policy §2.13). Compromised passwords are rejected.

In case of suspicious login attempts, the platform may require the completion of a CAPTCHA challenge (Cloudflare Turnstile) to prevent automated attacks.

In case of unauthorized access or suspected account compromise, the User must notify support@easybordero.it immediately.

5. Plans and payments

5.1 Available plans

  • Free Plan — free, up to 3 imports per month, basic functionalities. No payment data required.
  • Pro Plan — access to all functionalities, unlimited imports, ticket support. 14-day free trial. For Business customers (with VAT) only the annual plan with SDI electronic invoicing is available. Current Pro plan prices are indicated on the checkout page and in the user dashboard.
  • Agency Plan — multi-DJ management with delegations, audit log and shared calendar, intended for agencies and collectives. Available on request: write to info@easybordero.it for activation and customized quote based on the number of DJs managed.

5.2 Payment methods

Payments are processed by Stripe Inc. (payment sub-processor). Billing is in advance and renewal occurs automatically at the end of the period (monthly or annually, depending on the chosen plan). EasyBorderò does not store credit card data.

For each payment, an electronic invoice is issued in compliance with Italian tax obligations (D.P.R. 633/72), transmitted to the Interchange System (SDI) via ACube S.r.l. (registered in Italy).

5.3 Cancellation and refunds

The User can cancel the subscription at any time from the Account section. Cancellation takes effect at the end of the period already paid; no refunds are provided for periods in progress, except for the 14-day right of withdrawal described above.

5.4 Free trial

At the end of the trial period, if not cancelled, the plan will be charged automatically. The User will receive a reminder email 3 days before the end of the trial.

Free trial applied only once per account (lifetime): the 14-day free trial period is applied only once for each EasyBorderò account. Once consumed (even only partially, regardless of subsequent cancellations or reactivations of the plan), subsequent reactivations result in immediate charge at checkout without further trial. The rule applies to prevent abusive use of the trial period (multiple cancellations and re-registrations to repeatedly obtain the free trial).

5.5 Price changes

EasyBorderò reserves the right to change prices with a minimum notice of 30 days via email. The User can cancel the subscription before the new rates come into effect.

5.6 Tax data for invoicing

For Business customers (with VAT number), the subscription requires entering complete tax data: business name, VAT number, complete address, SDI recipient code or PEC, legal form and, if applicable, REA number. Tax data is encrypted at-rest and used exclusively for the issuance of the SDI electronic invoice. The responsibility for the correctness and updating of such data is the User's.

5-bis. SIAE Account: unique and permanent connection

SIAE account uniqueness: each SIAE account can be linked to only one EasyBorderò account. Attempts to link SIAE credentials already in use by another User are automatically blocked by the system. Aligned with SIAE Terms of Service (1 email = 1 registry = 1 SIAE account per person).

Permanent binding: once a User links a SIAE account to their EasyBorderò profile, such link is permanent by design. The User can only update the password (if they change it on the SIAE portal), but cannot change the email/SIAE registry linked. For exceptional cases (e.g. lost account recovery, documented fiscal registry change) the User can contact support.

Automatic security notification: if someone attempts to link the SIAE credentials of an existing User to another EasyBorderò account, the original owner receives automatically a security email with the attempter's identity masked. The tracking of the attempt (time, masked email hash, IP/User-Agent) is kept as an anti-fraud measure.

Legal basis: legitimate interest (Art. 6(1)(f) GDPR — fraud/abuse prevention) + performance of the contract (Art. 6(1)(b) GDPR). See also Privacy Policy.

5-ter. Email communications (NEW in v1.2)

By registering with EasyBorderò, you accept to receive the following categories of emails, each subject to distinct rules and rights as indicated in our Privacy Policy §2.17:

  • Transactional and service emails (SYSTEM) — necessary for the performance of the contract (e.g. email verification, password reset, payment confirmations, receipts, essential technical notifications). Not disableable without deleting the account: these are operational communications mandatory for using the Service.
  • Product updates (PRODUCT_UPDATE) — notifications about new features, significant UX improvements, operational tips, deprecation notices, changes in pricing or policy. Sent on the basis of the data controller's legitimate interest (Art. 6(1)(f) GDPR) pursuant to GDPR Recital 47. Active by default for all Users, but disableable at any time with one click (see below).
  • Marketing communications (MARKETING) — offers, promotions, discounts, educational content with purchase calls-to-action. Sent only with prior explicit consent of the User (Art. 6(1)(a) GDPR + Art. 130 of Italian Legislative Decree 196/2003). Inactive by default; require active opt-in from the preference center or dedicated checkbox.

5-ter.1 Preference center

The User can manage their communication preferences at any time from the Account > Email Preferences section. From there it is possible to enable/disable the PRODUCT_UPDATE and MARKETING categories, view the history of recent emails received, and revoke consents previously granted.

5-ter.2 One-click unsubscribe (RFC 8058)

Every PRODUCT_UPDATE or MARKETING email includes in the footer an Unsubscribe link that immediately deactivates future sending of that category, with a single click and without requiring login, in compliance with the technical standard RFC 8058 (One-Click List-Unsubscribe) and the requirements of the ePrivacy Directive 2002/58/EC art. 7. The effect is immediate; no "we are processing your request" emails are sent.

5-ter.3 Withdrawal of consent (Art. 7(3) GDPR)

For the MARKETING category (legal basis: consent), the User can withdraw consent at any time with the same ease with which it was granted. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

5-ter.4 Right to object (Art. 21 GDPR)

For the PRODUCT_UPDATE category (legal basis: legitimate interest), the User has an unconditional right to object to the processing, exercisable through the same tools (Unsubscribe link or preference center). The objection takes immediate effect.

5-ter.5 Sender identification and content

Every PRODUCT_UPDATE or MARKETING email includes in the footer: complete sender identity (Tune Mates di Olivari Marco (sole proprietorship) — VATIT03340720212, Via Aurelio Nicolodi 5, 39100 Bolzano), explicit reason for receipt (e.g. "You are receiving this email because you have an account on EasyBorderò"), link to the Privacy Policy and these Terms, link to the preference center and the one-click unsubscribe mechanism. Emails do not contain third-party advertising, affiliate links or referral payouts in favor of subjects other than EasyBorderò itself.

6. Use of the service and limitations

The User is solely responsible for the accuracy of the data entered (tracks, playlists, music programs) and for the conformity of the generated reports with what is actually performed. EasyBorderò automates the compilation and proposes AI-assisted matches, but does not verify the correctness of the data provided by the User and does not guarantee the correctness of AI suggestions: the User is required to check and confirm the music program before submission.

It is prohibited to:

  • Reverse engineer, decompile or disassemble the software;
  • Perform automatic scraping of platform data or SIAE APIs via EasyBorderò;
  • Abuse the APIs with anomalous request volumes or unauthorized automations;
  • Share account credentials with third parties (for legitimate multi-user sharing see the Agency Plan);
  • Use the Service for illegal purposes or in violation of the SIAE Terms of Service;
  • Attempt to access data of other Users;
  • Publish on the User's social channels, through EasyBorderò, illegal, defamatory content, harmful to third-party rights, or in violation of the policies of the destination social platforms;
  • (v1.2) Attempt to disable the one-click unsubscribe mechanisms or the anti-fraud protection measures of the preference center (e.g. automated access to the unsubscribe links of third parties).

EasyBorderò is not responsible for errors or rejections of the borderò by SIAE systems that are independent of the platform (e.g. SIAE maintenance, errors in User data, expired or invalid SIAE credentials), nor for the failure to publish content on destination social networks for reasons attributable to those platforms (social account suspension, API changes, content rejection, etc.).

7. Non-affiliation with SIAE

EasyBorderò is an independent automation tool that interacts with the SIAE reserved area using the credentials provided by the User. EasyBorderò is not affiliated with, authorized by, or approved by SIAE. The User is responsible for compliance with the SIAE Terms of Service when using their credentials and submitting borderò.

8. Limitation of liability

The Service is provided "as-is". EasyBorderò does not guarantee uninterrupted availability of the Service nor continuous availability of SIAE APIs and systems, Stripe, AI providers (Google Gemini, Anthropic Claude) or destination social networks, which depend on independent third parties.

EasyBorderò shall not be liable for indirect, incidental, special, consequential or punitive damages arising from the use or inability to use the Service, including but not limited to: loss of data, failure to submit borderò, SIAE penalties attributable to User errors, third-party claims relating to content published by the User on their own social channels through the platform.

EasyBorderò's maximum liability to the User cannot in any case exceed the amount paid by the User in the 12 months preceding the harmful event.

9. Intellectual property

The EasyBorderò software, design, trademark and all content of the platform (including the editorial blog) are the exclusive property of the data controller (Tune Mates di Olivari Marco (sole proprietorship) — VATIT03340720212) and are protected by copyright and intellectual property regulations. Unauthorized reproduction, distribution or use is prohibited.

User data (playlists, tracks, music programs, borderò) remains the exclusive property of the User. EasyBorderò does not claim any rights on such data and processes it exclusively to deliver the Service.

10. Termination and suspension

EasyBorderò reserves the right to suspend or terminate access to the Service in case of: violation of these Terms, fraudulent activities, abuse of the Service, non-payment.

In case of suspension for violation of the Terms, no pro-rata refund is provided for the unused period. The User will be notified via email, except in cases of serious violations requiring immediate suspension.

The User can delete their account at any time from the Account section. Upon deletion, personal data will be processed as described in the Privacy Policy. (v1.2) Account deletion entails the immediate deactivation of all email categories (including residual PRODUCT_UPDATE and MARKETING); the right to retain historical consents (Art. 7 GDPR — burden of proof) is preserved in pseudonymized form via email hash, even after deletion, as detailed in the Privacy Policy §5bis.

11. Changes to the service and terms

EasyBorderò reserves the right to modify the Service functionalities, prices or these Terms at any time. For material changes to prices or Terms, a minimum notice of 30 days will be provided via email. For non-material changes, the update will be visible on this page with the updated revision date.

12. Applicable law and competent court

These Terms are governed by Italian law. For any dispute relating to the interpretation or execution of this contract, the competent court is that of the consumer's residence or domicile, pursuant to D.Lgs. 206/2005 (Italian Consumer Code). For disputes with professional users, the exclusively competent court is that of Bolzano.

Change-log v1.2.1 → v1.2.2 (2 June 2026)

  • Reworded the operational notice at the top of the document to reflect the progressive cutover status of the Email Campaigns module described in §5-ter: SYSTEM, preference center and one-click unsubscribe are operational as of 31 May 2026; the actual sending of the PRODUCT_UPDATE and MARKETING categories remains subject to subsequent explicit enablement by the controller, with notification to users at go-live.
  • Aligned the controller denomination with Privacy Policy v1.4.3: Tune Mates replaced with Tune Mates di Olivari Marco (sole proprietorship) in §1 Definitions, §5-ter.5 Sender identification, §9 Intellectual property and §13 Contact, in compliance with the transparency principle under Art. 13(1)(a) GDPR and with pre-contractual disclosure obligations under Art. 49 of Italian Legislative Decree 206/2005 (Consumer Code).
  • Added country prefix "IT" to the VAT number (IT03340720212) for consistency with the VIES representation and B2B documentation (SDI, e-invoices, DPA), aligning the Terms with Privacy Policy v1.4.3.
  • Non-substantive change: informative alignment with the operational status of the system and editorial clarification of the controller's identity. No change to economic obligations, SIAE-related rights, liability limitations or the substantive provisions of §5-ter (categories, legal bases, opt-out/withdrawal rights, RFC 8058).

Change-log v1.2 → v1.2.1 (26 May 2026)

  • Added an operational notice at the top of the document regarding the progressive rollout of the Email Campaigns module (§5-ter), in alignment with the contextual Privacy Policy v1.4.1 update. No substantive change to the parties' obligations.

Change-log v1.1 → v1.2 (25 May 2026)

  • Added §5-ter Email communications with 5 sub-sections (email categories SYSTEM/PRODUCT_UPDATE/MARKETING, preference center, RFC 8058 one-click unsubscribe, Art. 7(3) consent withdrawal, Art. 21 objection, sender identification and content).
  • Added prohibition in §6 to attempt to bypass unsubscribe/preference center mechanisms.
  • Added in §10 note on immediate effect of account deletion on email consents + pseudonymized retention for burden of proof.
  • No material changes to economic obligations, SIAE rights or limitations of liability. The changes are informative in nature for alignment with the Privacy Policy v1.4 and with the new internal Email Campaigns module.
